A judge's literary bias does come into play:
PW Daily, 9/4/09
Second Circuit Weighs Appeal in Salinger Case
By Andrew Albanese
A three-judge panel of the U.S. Second Circuit Court of Appeals yesterday heard arguments that a preliminary injunction barring U.S. publication of Swedish author Fredrik Colting’s 60 Years Later: Coming Through the Rye should be vacated. Despite a negative review of Colting’s book by one of the judges, Guido Calabresi, who called the effort a “dismal piece of work,” the judges’ questions suggested that the court was leaning toward giving Colting a second look in court.

“This case is about banning a book,” Ned Rosenthal, lead counsel for Colting, told the court, noting that such an extreme action should only happen after vigorous consideration of all the issues. In addition, Rosenthal argued, no evidence of any actual harm had been introduced in the preliminary hearing.

Groups Urge Injunction be Vacated in Salinger Case
Andrew Albanese
The Second Circuit Court of Appeals will hear oral arguments on September 3 to help decide whether an injunction barring publication of Swedish author Fredrik Colting’s 60 Years Later: Coming Through the Rye constitutes an “impermissible prior restrain and an unwarranted extension” of copyright protection. Lawyers for author J.D. Salinger claim 60 Years is an “unauthorized sequel” to The Catcher in the Rye. A number of high profile organizations, including major media companies like the New York Times, the Associated Press, Gannett, and Tribune, as well as librarians, free speech advocates, and legal scholars, have filed amicus briefs supporting Colting, urging the Appeals Court overturn Judge Deborah Batts’ injunction barring U.S. publication, asserting that Batts erred by not allowing the case to proceed to a full trial.

Appeal Filed to Overturn Ban in Salinger Case
from PW Daily, July 24, 2009
By Andrew Albanese
Lawyers for Swedish author Fredrik Colting and his U.S. distributor, SCB Distribution, filed an appeal on July 23 with the Second Circuit Court of Appeals arguing that a July 1 injunction barring publication of Colting’s 60 Years Later: Coming Through the Rye, is an “impermissible prior restrain and an unwarranted extension” of copyright protection. “Without a shred of evidence of harm, the Plaintiff, the District Court has taken the extraordinary step of enjoining the publication of the book,” court documents read. “But [the book] is a complex and undeniably transformative comment on one of our nation’s most famous authors, J.D. Salinger, his best known creation, Holden Caulfield, and his most celebrated work, The Catcher in the Rye.”

They are going to appeal, of course. Definitely a case to follow for its potential impact on copyright and author's recourses. Thanks for commenting!

I wrote about this case, too, as StLouis Lit Examiner, as well as the Rowlings/Lexicon case. Knowing the premise of the book, I don't agree with the judge's statements about this case at all. I sure understand Salinger's anger, though.
